Knowing your rights and your employees rights
From a privacy point of view employees are under no obligation to tell their employer that you have a mental illness and if they do this information must remain confidential and cannot be used to discriminate against the employee.
However, from an occupational health and safety perspective, if the symptoms of an employee’s illness and or any associated medication they are taking have the potential to put themselves or others at risk in the workplace the employee is obliged to tell their employer about the illness.
